Confidence Guarantee Terms

The Nombrio Confidence Guarantee provides assurance in the accuracy of our trademark screening. If we miss a trademark conflict that our search should have found, we will refund your report fee.

1. What the Guarantee Covers

The Confidence Guarantee covers situations where Nombrio's trademark screening fails to identify a registered trademark that:

• Was registered in the USPTO, EUIPO, or UK IPO databases at the time of your search
• Falls within the same or closely related Nice Classification classes as your use case
• Would have been identified through a reasonably diligent search of the covered registries

2. Eligibility

To be eligible for a guarantee claim, you must:

• Have purchased a Premium report that includes the Confidence Guarantee
• Submit your claim within 12 months of the original report date
• Provide evidence of the trademark conflict that was missed
• Have used the name in commerce or incurred demonstrable costs related to the naming decision

3. What the Guarantee Does Not Cover

• Trademarks filed or registered after the date of your Nombrio search
• Common-law (unregistered) trademark rights not appearing in official databases
• Trademark registries not included in our search (we cover USPTO, EUIPO, and UK IPO)
• Subjective assessments of likelihood of confusion — only missed registrations
• Any indirect, consequential, or punitive damages (legal fees, lost revenue, rebrand costs, etc.)

4. Refund Amount

The guarantee refund is limited to the amount you paid for the Premium report. It is not insurance and does not cover legal fees, rebranding costs, or any other expenses beyond the report fee.

5. Claim Process

1. Email support@nombrio.com with the subject line “Guarantee Claim”
2. Provide the search ID and the conflicting trademark details
3. Our team will review the claim within 10 business days
4. If approved, your refund will be processed within 5 business days

6. Claim Window

Claims must be submitted within 12 months of the original report purchase date. Claims submitted after this window will not be eligible for a refund.
